Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the SagaraProductions.com website (the “Service”) operated by Sagara Productions Inc. (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Sagara Productions Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
2. License Agreement for Digital Products (Sample Packs & Presets)
When you purchase or download sample packs, presets, or other audio assets (“Digital Products”) from SagaraProductions.com, you are not purchasing the copyright to the sounds. You are purchasing a non-exclusive, non-transferable license to use the sounds in your own productions.
Allowed Uses
You are permitted to use the Digital Products in the following ways:
Commercial & Non-Commercial Productions: You may use the samples and presets as part of your own original musical compositions, beats, sound effects, audio for video, films, video games, and other media productions.
Royalty-Free: Once purchased/downloaded, you may use the sounds in your productions without paying additional royalties to Sagara Productions Inc.
Prohibited Uses (Strictly Enforced)
You are not permitted to use the Digital Products in the following ways:
No Resale of Standalone Assets: You may not sell, license, or distribute the samples or presets individually or in isolation. You cannot repackage our sounds and sell them as your own sample pack or preset bank.
No Re-uploading or File Sharing: You are strictly prohibited from re-uploading, sharing, or distributing the sample packs or preset banks to other websites, torrent sites, file-sharing networks, peer-to-peer services, or shared drives.
No “Sound-Alike” Libraries: You may not use these sounds to create a competing sample library or virtual instrument.
3. Purchases
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.
4. Refunds
Due to the nature of digital downloads (Sample Packs and Presets), all sales are generally considered final. Refunds may be issued at the sole discretion of Sagara Productions Inc. in cases of technical failure where the product cannot be accessed.
5. Limitation of Liability
In no event shall Sagara Productions Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
7. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
